S C Set Aside Centre’s Notification To Extend Reservation To “Politically Organised” Jat Community

Supreme Court today set aside the Centre’s notification to extend the benefit of reservations to the Jat Community.

A Bench headed by Justice Ranjan Gogoi has held that the Centre’s decision to overlook the findings of an OBC panel that Jat is not a backward class, was at fault.

The Bench said that Caste, though a prominent factor, can not be the sole factor to decide backwardness.

The Bench also said that possible wrong inclusion of a caste in the OBC list in the past, cannot be the basis of further wrong inclusions.

The Court said that Inclusion of politically organised castes like Jat in OBC list, is not good for other backward classes.
