Madhya Pradesh High Court terms reservation in promotions in the State as unconstitutional

The Madhya Pradesh High Court Saturday termed reservation in promotions in the state as unconstitutional.

The division bench chaired by Chief Justice A M Khanwilkar stated in its order that the reservation to underprivileged during appointments is logical but reservation in promotions frustrate talented people.

The court said that giving priority to reserved categories over general classes in promotions is not justice.

Several employee associations and social organisations had filed petitions against reservation in promotions in the court.

Petitioners had challenged the rules of the state government which provided reservation in promotion for Scheduled Castes and Schedule Tribes.

Petitioners urged that these rules are against provisions of the constitution.

All the reservation based promotions after 2002 will be cancelled after the court’s judgement.
